Before his trial was scheduled to start yesterday, Jessie Gaines 37, agreed to a plea bargain and pleaded guilty to aggravated assault, having a weapon while an ex-felon and discharging a weapon into a home. He made an Alford plea, which meant he pleaded to the charges to avoid possible consequences if found guilty at trial. The Lake County prosecutor's office dismissed a felonious assault charge, lowering it to aggravated assault, and a charge for violating a temporary restraining order.

Badley, 20, was sentenced April 25 by Lake County Common Pleas Judge Martin 0. Parks after pleading guilty March 19 to a charge of aggravated assault. Parks suspended an 18- month prison term and sentenced Badley to 90 days in jail and put him on two years' probation. Badley had shot Maurice Ferguson after a fistfight over Ferguson dating Badley's younger sister. Badley had been charged with felonious assault, which carried a maximum 15-year sentence, Special Prosecutor Michael D.
Murray said. But Ferguson wouldn't cooperate and could not be found at the time of the trial in March, Murray said. Murray said the victim was not always needed for trial, but in this case, he said, the jury needed to know Ferguson's version of events. Murray said he was faced with dismissing the case, trying it and possibly losing, or taking what he could, which was a guilty plea on a lesser charge of aggravated assault. Murray said Badley shot Ferguson, but the dispute was whether Badley did it intentionally or the gun went off accidentally during a struggle.
